Welcome to 10PB (“10PB,” “we,” “us,” or “our”).
These Terms of Service (“Terms”) govern your access to and use of the 10PB website, customer portal, cloud storage services, S3-compatible object storage, backup and recovery services, data archiving, file sharing, data transfer tools, APIs, and related products and services (collectively, the “Services”).
10PB is operated by Netforchoice Data Center, with its applicable business address at 10 PetaByte Solutions Pvt. Ltd. A-86, Block A, Sector 57 Noida Uttar Pradesh - 201301 India
By accessing our website, creating an account, purchasing a subscription, or using any Service, you agree to these Terms and the policies referenced in them. If you do not agree, you must not use the Services.
If you use the Services on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms. In that case, “you” and “your” refer to that organization.
You must have the legal capacity to enter into a binding agreement under applicable law to create an account or purchase our Services.
To use account-based Services, you may be required to provide accurate information, including your name, email address, telephone number, organization details, and billing information.
You agree to:
We may request additional information where reasonably necessary for account verification, fraud prevention, billing, security, or legal compliance.
We reserve the right to reject, restrict, or suspend an account where permitted by law and these Terms, including where registration information is materially false or fraudulent.
10PB provides cloud-based data storage and related technology services. Depending on the product and plan, these may include:
The features, storage limits, performance characteristics, access methods, support levels, and pricing applicable to your account will depend on the selected plan, product documentation, order form, or separate written agreement.
We may introduce, improve, modify, or discontinue features in accordance with these Terms and any applicable contractual commitments.
10PB may offer free accounts, introductory plans, trials, paid subscriptions, usage-based services, or customized business agreements.
The availability and terms of each plan will be described on the website, customer portal, applicable order form, or other relevant service documentation.
Unless expressly stated otherwise:
We may change plan features or introduce new plans, subject to applicable law and any existing contractual commitments.
Before purchasing a paid Service, you should review the applicable price, billing period, included capacity, usage limits, and other material terms.
Unless otherwise specified in an order form or agreement:
If there is a discrepancy between a general website description and a signed order form, the signed order form will govern for the specific transaction to the extent stated in that agreement.
For paid Services, you agree to pay all fees associated with your selected plan and authorized usage.
Billing frequency, payment methods, invoicing arrangements, and renewal terms will be specified at checkout or in your applicable order form.
Where a subscription automatically renews, the renewal frequency and applicable price should be disclosed before you commit to the subscription. You may cancel future renewal in accordance with the cancellation process provided for your plan.
You are responsible for keeping payment information current and for notifying us of billing discrepancies within a reasonable period.
If a payment fails or an invoice remains overdue, we may notify you and request payment. Subject to applicable law and your agreement, we may restrict or suspend affected Services if the issue is not resolved.
Any late fees, interest, collection costs, or administrative charges will apply only where disclosed in the applicable agreement and permitted by law.
Cancellation and refund eligibility depend on the Service purchased, the applicable order terms, and mandatory consumer-protection requirements.
Unless otherwise stated in a separate agreement or required by law:
Nothing in these Terms excludes any refund, cancellation, or other right that cannot lawfully be excluded.
Before publishing: 10PB should link a separate Refund and Cancellation Policy here once its actual refund rules, processing timelines, and treatment of unused subscription periods have been confirmed.
“Customer Content” means files, documents, records, backups, objects, media, metadata, and other information that you or your authorized users upload, store, transmit, or process using the Services.
As between you and 10PB, you retain your ownership rights in Customer Content, subject to any rights held by third parties.
You are responsible for:
You grant 10PB a limited, non-exclusive right to host, store, reproduce, transmit, back up, and process Customer Content only as reasonably necessary to provide, maintain, secure, and support the Services, comply with applicable law, and perform our contractual obligations.
This limited right does not transfer ownership of your content to 10PB.
We will handle Customer Content in accordance with our Privacy Policy, any applicable Data Processing Agreement, and our contractual commitments.
Our collection and use of personal information are described in the 10PB Privacy Policy: https://10pb.com/privacy-policy.php
By using the Services, you acknowledge that you have had the opportunity to review that policy.
Where you use the Services to store or process personal data relating to other individuals, you are responsible for determining your legal obligations and ensuring that you have an appropriate legal basis and necessary authorizations.
Where applicable, the parties will enter into a separate Data Processing Agreement (“DPA”) that specifies their respective data-protection obligations.
If a DPA or another signed agreement applies to your use of the Services, its provisions will govern the relevant data-processing matters to the extent of any conflict with these Terms.
10PB uses technical and organizational measures intended to protect the Services and Customer Content. Depending on the product, these measures may include encryption, authentication, access controls, monitoring, and infrastructure safeguards.
However, no internet-connected service or security measure can guarantee absolute protection against every threat, unauthorized access attempt, or technical failure.
You are responsible for using available security controls appropriately, protecting your credentials, assigning access according to least-privilege principles, and promptly reporting suspected security incidents.
You must not attempt to bypass security controls, access another customer's data without authorization, introduce malicious software, or interfere with the integrity or availability of the Services.
You are responsible for determining whether the Services meet your data availability, retention, recovery, and business-continuity requirements.
Unless expressly included in your plan or a separate written agreement:
You should maintain an appropriate independent backup or recovery strategy for critical data, particularly where data loss could materially affect your business or legal obligations.
Any additional availability commitment, recovery objective, or service credit will be governed by the applicable Service Level Agreement (“SLA”) or signed agreement.
Your use of the Services is subject to the 10PB Acceptable Use Policy (“AUP”), which forms part of these Terms.
You must not use the Services to:
The complete AUP is available at https://10pb.com/aup-pb.php.
A violation may result in proportionate restrictions, suspension, or termination in accordance with these Terms, the AUP, applicable law, and any relevant service agreement.
We aim to provide reliable access to the Services, but uninterrupted availability cannot be guaranteed unless expressly stated in an applicable SLA or signed agreement.
Services may occasionally be unavailable or degraded due to maintenance, upgrades, network conditions, equipment failures, security incidents, third-party dependencies, or events outside our reasonable control.
Where reasonably practicable, we may provide advance notice of planned maintenance that is expected to materially affect a Service.
Any formal uptime commitment, exclusions, measurement methodology, support response targets, or service-credit arrangement will be governed by the applicable SLA.
General marketing statements on our website do not replace the specific terms of an applicable SLA or signed service agreement.
The 10PB name, brand assets, website design, software, interfaces, documentation, and other materials provided by 10PB are owned by or licensed to the relevant rights holder and are protected by applicable intellectual- property laws.
Except as expressly permitted by law or an applicable written agreement, you must not:
These Terms do not grant you ownership of 10PB intellectual property. Any software license or additional usage rights will be governed by the applicable license or agreement.
The Services may support third-party applications, platforms, networks, APIs, or tools.
Your use of a third-party service may be subject to separate terms, privacy policies, technical limitations, and charges imposed by that provider.
You are responsible for ensuring that your integrations are properly authorized and configured. 10PB is not responsible for independent third-party services or their acts and omissions, except to the extent required by law or expressly agreed in writing.
S3 compatibility or compatibility with another platform does not imply that 10PB is affiliated with, endorsed by, or sponsored by that platform's owner.
We may restrict or suspend all or part of your access where reasonably necessary and legally permitted, including when:
Where reasonably practicable and lawful, we will notify you and provide an opportunity to remedy the issue before imposing a significant restriction.
We may act without advance notice where necessary to address an urgent security threat, comply with law, or prevent material harm.
Any suspension, preservation, access restriction, or handling of Customer Content will remain subject to applicable law and our contractual obligations.
You may stop using the Services and request account or subscription termination through the applicable cancellation process.
We may terminate these Terms or affected Services where permitted by law and the applicable agreement, including for a material breach that remains unresolved after any required notice or cure period.
Upon termination:
Before terminating a paid Service, you should export any data you need and review the applicable data-retrieval and deletion terms.
10PB should specify its actual post-termination data retrieval window and deletion timeline in its published service documentation or customer agreement.
We may update these Terms to reflect changes in our Services, business operations, security practices, or legal requirements.
The updated Terms will be published on our website with a revised “Last Updated” date. Where required by law or contract, we will provide appropriate notice of material changes.
Changes will take effect on the date specified in the updated Terms, subject to applicable law and any existing contractual commitments.
If you do not agree with a material change, you should discontinue use of the affected Services and follow the applicable cancellation or termination process.
To the maximum extent permitted by applicable law, and except for express commitments contained in an applicable written agreement, the Services are provided subject to the features, limitations, and conditions described in the applicable product documentation and service terms.
We do not warrant that the Services will be uninterrupted, error-free, compatible with every system, or capable of meeting every individual requirement.
We do not guarantee that all data can always be recovered following accidental deletion, corruption, security incidents, infrastructure failure, or other events, except where a specific recovery commitment is expressly made in writing.
Nothing in these Terms excludes any warranty, representation, or consumer right that cannot lawfully be excluded or restricted.
To the maximum extent permitted by applicable law, neither party will be liable to the other for indirect, incidental, special, exemplary, or consequential losses, or for loss of profits, revenue, business opportunities, goodwill, or anticipated savings arising from the use of or inability to use the Services, where such exclusion is legally enforceable.
To the maximum extent permitted by applicable law, and subject to any different limits in a signed agreement, the total aggregate liability of either party arising out of or relating to the relevant Services will not exceed the fees paid or payable for those Services during the twelve (12) months immediately preceding the event giving rise to the claim.
The above exclusions and cap will not apply to liabilities that cannot lawfully be excluded or limited. Any exceptions, including those relating to fraud, wilful misconduct, confidentiality, data protection, intellectual-property infringement, or payment obligations, must be specified in the applicable agreement and reviewed for enforceability under applicable law.
Nothing in this section limits any mandatory rights or remedies available under applicable law.
To the extent permitted by applicable law, you agree to indemnify and hold harmless 10PB and its relevant personnel from third-party claims, losses, and reasonable costs arising directly from your unlawful use of the Services, your material breach of these Terms, or your infringement of a third party's rights through Customer Content or your use of the Services.
This obligation will not apply to the extent that a claim results from 10PB's own breach, negligence, wilful misconduct, or other conduct for which indemnification cannot lawfully be required.
We will provide reasonable notice of a claim for which indemnification is sought and cooperate as reasonably necessary. No settlement that imposes an admission of liability or a non-monetary obligation on the indemnifying party may be entered into without that party's consent, not to be unreasonably withheld.
Neither party will be responsible for a delay or failure to perform an obligation to the extent caused by circumstances beyond its reasonable control, such as natural disasters, war, civil unrest, widespread network outages, power failures, government actions, or other comparable events.
The affected party will take reasonable steps to mitigate the impact and resume performance as soon as reasonably practicable.
This section does not excuse payment obligations for Services already provided or override any mandatory legal requirement.
These Terms will be governed by the laws of India, subject to applicable conflict-of-law rules and mandatory legal protections.
The parties will attempt to resolve disputes through good-faith discussions before initiating formal proceedings, where appropriate.
Nothing in this section removes any mandatory right to approach a competent court, regulator, consumer commission, or other authority where such a right is available under applicable law.
Entire agreement: These Terms, together with applicable order forms, the AUP, Privacy Policy, SLA, DPA, and other incorporated agreements, form the agreement governing your use of the relevant Services.
Order of precedence: If documents conflict, the applicable signed order form or negotiated agreement will prevail for the relevant transaction to the extent it expressly addresses the conflict. A DPA will govern the data-protection matters within its scope, and an SLA will govern the service-level commitments within its scope.
Severability: If any provision is held invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
No waiver: A failure to enforce a provision does not constitute a waiver of the right to enforce it later.
Assignment: You may not transfer your rights or obligations under these Terms without our prior written consent, except where applicable law permits otherwise. We may assign these Terms in connection with a lawful restructuring, merger, or transfer of the relevant business, subject to applicable law and contractual obligations.
No agency: These Terms do not create a partnership, joint venture, employment, or agency relationship between the parties.
Electronic communications: You agree that notices and communications may be provided electronically where permitted by law. Certain formal notices may need to be sent through a specific channel or in a particular form under applicable law or your agreement.
